Case No.320 of 2025 corresponding to C.T. Case No.811 of 2025 registered for the alleged commission of offences punishable under Sections 140(3)/296/308(4)/351(3)/3(5) of the BNS, 2023, pending in the Court of the learned J.M.F.C.-V, Bhubaneswar. 3. Earlier, the petitioner had approached this Court seeking anticipatory bail by moving ABLAPL No.108 of 2026. The Coordinate Bench of this Court, after considering the merits of the case, did not give indulgence to the petitioner, rather dismissed the application vide order dated 09.01.2026. Therefore, the petitioner has approached this Court by filing the present bail application for the second time without there being any substantial change in the circumstances. 5. When it is confronted, learned counsel for the petitioner seeks to withdraw the present bail application, rather preferred to surrender before the trial Court and move regular bail application on merit. 6. The ABLAPL is disposed of directing the petitioner to surrender before the trial Court on or before 15.05.2026 and move regular bail application urging all the grounds as has been urged in the present petition. 7. It is expected that the learned trial Court shall deal with the bail application of the petitioner and decide the same in accordance with law on merit on the same day. 8. With the aforementioned observation, the ABLAPL is disposed of. (S.S. Mishra) Judge Subhasis Designation: Personal Assistant Location: High Court of Orissa, Cuttack.
