By means of the present application, the applicant seeks anticipatory bail in connection with Case Crime No. 0019 of 2023, registered at Police Station Nehru Colony, District Dehradun, for the offences punishable under Sections 420, 467, 468, 471 & 120-B I.P.C. 4. Learned counsel for the applicant would submit that, according to the First Information Report, the informant allegedly received secret information to the effect that the applicant and certain other persons had obtained forged Bachelor of Ayurvedic Medicine and Surgery (B.A.M.S.) degrees by preparing fabricated documents in connivance with some employees of the Indian Medical Council, Uttarakhand. It is alleged that, during the course of enquiry, it was found that the named accused persons had procured such degrees on payment of a sum of ₹6,00,000/- to persons allegedly engaged in the preparation and procurement of forged educational UKHC010029542023 2026:UHC:5502 certificates. It is further alleged that, pursuant to the said enquiry, the accused persons were apprehended and the alleged forged degrees were seized by the investigating agency. 5. Learned counsel for the applicant would further submit that the applicant is innocent and has falsely been implicated in the present case; that, the applicant possesses a Diploma in Unani Medicine and had been practising within the scope of the said qualification; that, the applicant had merely come into contact with the principal accused persons and has been unnecessarily roped into the present case. He would further submit that the applicant had only been administering basic Ayurvedic/Unani medicines having no adverse side effects, and throughout his practice no complaint whatsoever was ever made by any patient alleging negligence, cheating or malpractice on his part. 6. Learned counsel would further submit that the applicant has neither cheated any person nor forged, fabricated or manufactured any educational degree, certificate or document; that, on the contrary, the applicant himself is a victim of a well- organised syndicate allegedly engaged in the preparation and sale of forged educational qualifications, and he had no knowledge whatsoever that the degree in question was forged; that, a Coordinate Bench of this Court, by order dated 21.03.2023, granted interim protection from arrest to the applicant; that, pursuant thereto, the UKHC010029542023 2026:UHC:5502 applicant has duly cooperated with the investigation as and when required by the Investigating Officer. It is further submitted that the investigation has since been concluded and the charge- sheet has already been filed before the competent Court; that, No material has been brought on record by the prosecution to demonstrate that custodial interrogation of the applicant is either necessary or warranted at this stage. It is, therefore, prayed that the interim anticipatory bail granted in favour of the applicant be confirmed and made absolute. 7. Having heard learned counsel for the parties, perused the material available on record and considered the rival submissions, this Court finds that the applicant has remained protected pursuant to the interim order dated 21.03.2023 and has complied with the conditions imposed therein by extending full cooperation during the course of investigation. The investigation has culminated in submission of the charge-sheet before the competent Court, and no material has been placed before this Court to indicate that the custodial interrogation of the applicant is now required. Having regard to the nature of the allegations, the stage of the proceedings and the facts and circumstances of the case, and without expressing any opinion on the merits of the prosecution case, this Court is of the considered opinion that the applicant has made out a fit case for confirmation of the interim protection granted earlier. Consequently, the interim anticipatory bail granted to the applicant vide order dated 21.03.2023 is hereby confirmed and made absolute, subject to the conditions stipulated in the said order, as well as any further conditions that may be imposed by the learned trial Court, if considered necessary, in accordance with law. 9. The anticipatory bail application is, accordingly, allowed. 10. Pending applications, if any, shall also stand disposed of.
