This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for pre-arrest bail to the accused-applicant in connection with Rangia Police Station Case No. 135/2026 (G.R. No. 305/2026) under Sections 223/173/174 of the Bharatiya Nyaya Sanhita, 2023. 3. An FIR was lodged on 01.05.2026 by one Kumar Kalita, Executive Member, Bharatiya Janata Yuba Morcha, Asom Pradesh, alleging that during the last Legislative Election, 2026, on 07.04.2026, which was the last day of campaigning at about 5:00 PM, they saw some persons in two vehicles, one Maruti Suzuki Brezza bearing No. AS-01-FU-1947 and another Innova near Taranipuri Mandir; that the alleged vehicles were used by the Congress Party and certain financial transactions happened during that period; it was alleged that the executive workers of the BJP Yuba Morcha immediately intimated the same to the police administration, but nothing was done. 4. On receipt of the FIR, Rangia Police Station Case No. 135/2026 under Sections 223/173/174 of the Bharatiya Nyaya Sanhita, 2023 was registered. 5. The learned counsel appearing for the accused-applicant submits that the accused-applicant is a sales man working in Wintrobe Hospital, Guwahati and he is nowhere linked with any such type of transactions. She further submits that the maternal uncle’s house of the accused-applicant is located in Rangia and there may be certain occasions where his vehicle has been taken by his relative to Rangia. She submits that the police is visiting his house and threatened him Page No.# 3/4 to arrest him and therefore, being apprehensive, the instant anticipatory bail application has been filed by the accused-applicant. 6. Mr. D.P. Goswami, the learned Additional Public Prosecutor, on the other hand opposes the anticipatory bail application, stating that the Case Diary in the instant case is required. 7. Taking into account the fact that the incident alleged, happened on 07.04.2026, however, the FIR was lodged on 01.05.2026 and also taking into account the allegation that been made in the FIR, this Court is of the considered opinion that the accused-applicant should be granted pre-arrest bail. 8. Accordingly, it is directed that in the event of arrest of the accused- applicant, he shall be released on pre-arrest bail on furnishing a bail bond of Rs.30,000/- (Rupees Thirty Thousand) with a surety of like nature to the satisfaction of the arresting authority subject to the conditions that :- (i) The accused-applicant shall appear before the Investigating Authority within a period of 10 (ten) days of passing of this order. (ii) The accused-application shall cooperate with the investigation and make himself available as and when call for by the Investigating Officer. (iii) The accused-applicant shall not try to influence the evidence or any witnesses that may be involved in the instant case. 9.
