The learned counsel for the petitioners submits that the father of the petitioners, namely, Suresh Vishwakarma was a permanent employee of M/s Bharat Coking Coal Limited (BCCL) and he was allotted quarter no.R.H.29 at East Bhagatdih Colliery. He next submits that M/s Bharat Coking Coal Limited under the instructions of the District Administration took a decision to shift the project falling under the fire-zone area to a safe house and issued an order dated 17.07.2008 whereby the employees including the father of the petitioners were directed to vacate the company quarter and deliver possession of the same to the Manager and thereafter the father of the petitioners had vacated the said quarter and delivered the possession of the same to the management. He next submits that so far as the petitioners are concerned, they were residing at Boka Pahari at fire zone area as they have been engaged in their own business and they resided in separate houses, the authorities had demolished the said houses of the petitioners and the photograph of the same has been annexed with the petition. In these grounds, he submits that the representation has already been filed before the authority concerned, however, no decision has been [2026:JHHC:11566] -3- W.P.(C) No. 4139 of 2013 taken on the same. 3. Learned counsel for the respondent State submits that if the representation is pending, on that representation the authority concerned can take a decision, and in that view, the petitioner may kindly be directed to file a fresh representation before the authority concerned. 4. In view of above submission of the learned counsels for the parties, without entering into the merit of the case, this writ petition is hereby disposed of directing the petitioner to file a fresh representation before the respondent no.3/authority concerned within a period of two weeks, and the respondent no.3, after receiving the same, will decide the said representation within six weeks further thereafter and pass appropriate order in accordance with law. 5.
