The Writ Petition is filed for the following relief:
“…pleased to issue an appropriate writ or order or direction more particular in the nature of Writ of Mandamus declaring the action of the Respondents more particularly the 4th Respondent in not allowing the Petitioner for appointment by transfer to the Post of Junior Assistant, Accounts Service, as being illegal, arbitrary, discriminatory and in violation of Article 14, 16, 19, 21 of the Constitution of India, and consequently direct the Respondents 3 to 6 consider the Petitioner for the post of Junior Assistant by way of appointment by transfer, and pass…”
2. The case of the petitioner is that, the petitioner initially joined in service as fireman in the year 2016 under direct recruitment. At the time of issuing appointment orders, a condition was imposed under Clause 4(d), stating that the post of fireman is in essential uniformed services of A.P.G.E.N.C.O. and therefore the candidates appointed in uniformed services shall not be permitted to convert other services of A.P.G.E.N.C.O. for a period of 10 years. In view of the same, the case of the petitioner was not considered. Aggrieved by the same, the petitioner approached this Court in the above said Writ Petition.

Learned counsel for the petitioner contends that the petitioner possess all requisite qualifications for the purpose of appointment by transfer as Junior Assistants in Accounts Service Department from the A.P.G.E.N.C.O. fireman.
Learned counsel for the petitioner draws the attention of this Court to a similar situation, wherein the petitioners therein applied for the examination for appointment by transfer to the post of Junior Engineer and the same was rejected. The said rejection order was challenged before the Hon’ble Division Bench of this Court in W.A.Nos.854, 855 of 2022 and the Division Bench was
pleased to allow the petitioners therein to appear for the examination. He further submits that basing on the above said judgments, a coordinate Bench of this Court had granted interim order dated 08.09.2023, directing the respondents to permit the petitioners therein to appear for written examination. Accordingly, they appeared for the written examination held on 09.09.2023. However, the results were kept in sealed cover.
4. Upon considering the factual aspects and submissions of both the
learned counsel, on perusing the material on record, this Court is of the view that the condition imposed in the order of appointment is that the uniform services of fireman will not be permitted to convert into other service of A.P.G.E.N.C.O. for a period of ten years. Since the appointment was made on 10.03.2016, and the ten years period has now been elapsed, this Court is of the opinion that the petitioner is entitled to be considered for conversion of his service from A.P.G.E.N.C.O. Fireman to the post of Junior Assistant in the Accounts Service Department, in accordance with the applicable rules and regulations.
5. Accordingly, this Writ Petition is disposed of. The respondents are
directed to open the sealed cover and declare the result of the petitioner and consider his case for conversion, if he is otherwise eligible, within a period of two (02) months, from the date of receipt of a copy of this order. No costs.
Consequently, miscellaneous petitions if any, shall stand closed.
Interim orders granted earlier if any, also shall stand closed.
