The petitioner is apprehending his arrest in connection with Ichak P.S. Case No.54 of 2025, for offence registered under sections 309(6), 103(1) of BNS, 2023, and section 27/35 of Arms Act, pending in court of learned Judicial Magistrate, First Class, Hazaribag. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the petitioner’s name has come on confessional statement of the co- accused. He next submits that only allegation is made that the petitioner has planned for dacoity and in execution of the said dacoity one person has died who happened to be husband of the informant. 4. Learned State counsel opposes prayer and submits that the petitioner has planned for dacoity in which the husband of the 2026:JHHC:6964 2 informant has died and recovery of fire arms from the possession of the co-accused is there who was arrested by the police and the petitioner has not cooperated in the investigation and the investigation against the petitioner is still going on and the charge sheet has been submitted against three of the accused persons. 5. In the FIR itself it has come that this petitioner has planned the said dacoity and in course of the execution of the dacoity the husband of the informant has died and the petitioner is not cooperating in the investigation and the investigation against the petitioner is still going on and the charge sheet has been submitted against three of the co-accused persons, and as such, I am not inclined to grant anticipatory bail to the petitioner and hence, this petition being A.B.A. No.1018 of 2026 is hereby dismissed.
