Heard Mrs. S. Roy, learned counsel for the applicant and Mr. S. Ahmed,
learned counsel for respondent Nos. 1 to 3. The present application under Section 5 of the Limitation Act has been preferred by the applicant/ Insurance Company praying for condonation of delay of 12 days in preferring the connected MAC Appeal. Mr. S. Ahmed, learned counsel or the respondents submits that he has no objection in the instant application. The Court has perused the pleadings and find that the applicant has been able to show sufficient cause for the delay of 12 days in filing the connected MAC appeal against the impugned judgment and award dated 1/12/2025 passed in MAC case No. 326/2022 passed by the learned MACT, Bongaigaon. Accordingly, the instant application is allowed and disposed of and the
Page No.# 3/3 delay of 12 days in filing the connected appeal is condoned. Registry shall register the connected MAC Appeal and thereafter, list the same for admission after 3(three) weeks.
