Gogoi, learned counsel appearing for the accused-applicants. Also heard Mr. B. Sarma, learned Addl. P.P., representing the State respondent. This is an application filed under Section 483 of the BNSS, 2023, praying for grant of bail to the accused-applicant in connection with Jonai P.S. Case No. 36/2026, corresponding to G.R. Case No. 47/26, registered under Sections 121(2)/132/296/352/3 (5) of the BNS, 2023. A coordinate bench of this Court, vide order dated 26.05.2026 had already released one of the accused person, namely, Bhagyamoni Tayung, the accused- applicant no. 2 on bail. The learned counsel for the accused-applicants submits that a charge-sheet in the instant case has already been filed, vide charge-sheet No. 43/26 dated 02.06.2026 before the learned SDJM, Jonai, Assam. He submits that since the charge-sheet has already been filed, the accused-applicants will appear before the Trial Court as and when required and therefore, the custodial detention of the accused-applicant no. 1 and accused-applicant no. 3 may not be required in the instant case. Taking into account the entire aspect of the matter, this Court is of the considered opinion that the accused-applicant no. 1 and the accused-applicant no. 3 should be allowed to be released on bail on furnishing a bail bond of Rs. 20,000/- each with sureties of like amount to the satisfaction of the learned SDJM, Jonai, Assam, subject to the condition that the aforesaid accused-applicants shall appear before the Trial Court as and when called for.
