1. Heard Mr. A. K. Azad, learned counsel for the petitioner. Also heard Mr. M. P. Goswami, learned Additional Public Prosecutor for the State of Assam.
2. This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of PRC No.1335/2022, pending in the Court of the learned Additional Chief Judicial Magistrate, Goalpara.

3. The petitioner, Rubul Alom, has been shown as an absconder in the charge- sheet. Accordingly, the Trial Court, despite initially issuing summons to him, subsequently directed the issuance of a Non-Bailable Warrant of Arrest (NBWA) against him.
4. The petitioner submits that he is interested in facing the trial and, therefore, he deserves to be given an adequate opportunity to that effect.
5. I have heard the submissions made by the learned counsel of both sides.
6. This Court is of the opinion that since the petitioner is interested in facing the trial he deserves to be given an adequate opportunity to that effect. Therefore, his prayer is allowed.
7. All orders directing issue of NBWA against the petitioner, Rubul Alom in connection with PRC No.1335/2022 are set aside.
8. The petitioner, Rubul Alom is directed to appear before the Court of the learned Additional Chief Judicial Magistrate, Goalpara in connection with the PRC No.1335/2022 within a period of 15 (fifteen) days from today and on his appearance, he shall be allowed to go on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Goalpara.
9. With the aforesaid direction, this criminal petition stands disposed of. JUDGE Comparing Assistant
