This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Bonai PS Case No.181 of 2024 corresponding to Spl. GR Case No.99 of 2024 pending in the file of learned Addl. District Judge-cum-Presiding Officer, Special Court under POCSO Act, Sundergarh for commission of offences punishable U/Ss.64(2)(m)/351(2)/65(1) of BNS r/w Section 6 of the POCSO Act, on the main allegation of committing rape and aggravated penetrative sexual assault upon the victim. 3. Heard, Mrs. Anita Dash, learned counsel for the Petitioner appearing virtually and Mr. C. Mahanty, learned Addl. PP in the matter and perused the record, but none appears for the victim despite being duly intimated as apprised by the learned Addl. PP. 4. After having considered the rival submissions and taking into account the nature and gravity of the offence as alleged against the petitioner vis-a-vis the accusations sought to be brought against him and regard being had to the materials placed on record including the statement of the victim and keeping in view the other circumstances on record in entirety, this Court is not inclined to grant bail to the Petitioner at this stage, more particularly when the victim is yet to be examined. 5. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately transmitted to the learned trial Court. (G.
