Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than four years and till date the court could not pronounce its verdict. Learned advocate, therefore, submits that there has been violation of Article 22(1) of the Constitution of India and Section 47 of the BNSS, 2023, as such, the arrest being illegal, the petitioner may be released on bail. Learned advocate appearing for the State submits that earlier arguments were concluded and date was fixed for delivery of judgment when the Presiding Officer was transferred. Presently, the Presiding Officer has joined. However, it would take some time to conclude the arguments of the respective parties. Having considered the reasons assigned earlier by the learned trial court while rejecting the prayer for bail, I do not find 2 any illegality in the same. However, efforts be exhausted to conclude the arguments within a month from the next date fixed and thereafter within a month from the conclusion of the arguments, learned trial court would pronounce its verdict. With the aforesaid observations, CRM(M)499 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
