1. The Writ Petition (C) No.56/2021 has been filed for the following reliefs:-
"a. That, the Honble Court may kindly be pleased to allow the petition by directing the respondents to acquire and pay compensation 140 sqmtr. of khasra no. 212/12, and khasra no. 211/3 has not been acquired, but road has been made as N.H. 6 which are diverted land, therefore acquisition and compensation of remaining 140 sqmtr. be granted for the above said khasra and also khasra no. 212/3 (piece) undiverted agricultural land 300 sqmtr. has been also used for preparation of N.H. 6 road, hence acquisition and compensation be paid for this land khasra No. 212/12, 0.02 hectare = 280 sqmtr. (diverted land), khasra no. 211/3, 0.004 hectare = 40 sqmtr., total 320 sqmtr. out of which 180 sqmtr. acquired and for remaining 140 sqmtr. and also khasra no. 212/3 (piece 0.040 hectare = 400 sqmtr. undiverted) agricultural land, 300 sqmtr. has been taken for
3 making N.H. 6, so suitable direction of acquisition and payment of compensation to the petitioner be made within stipulated time."
2. Writ Petition No.87 of 2021 has been filed for the following reliefs:-
"a. That, the Hon'ble Court may kindly be pleased to allow the petition by directing the respondents to acquire the land of petitioner bearing khsara no. 212/11, 0.023 hectare, situated at Village Basna, Tahsil Saraipali, District Mahasamund (C.G.) by acquiring the same u/s 3(A) of National Highways Act and also to pay compensation within stipulated time so that old lady can survive and use benefits of her land, with interest."
3. Both writ petitions have been filed by the petitioners seeking compensation for the acquisition of their lands in lieu of construction of National Highway.

At the outset, the learned counsel for the State submits that in response to a communication made by the respondent National Highway Authority of India (NHAI), the Sub-Divisional Officer (Revenue) cum Competent Authority for Land Acquisition, Saraipali sent a communication dated 25.07.2018 (Annexure-R/2), which is filed along with the reply of the State and also sent a calculation sheet with the said communication. The said communication and calculation sheet show that the compensation has been determined for both the petitioners on the basis of mutual consent scheme and names of both the petitioners are reflected in the calculation sheet.

Learned counsel for respondent No.4 (NHAI) would not oppose the above submission. He states that on due execution of the sale deed based under mutual consent scheme, proceedings for the payment of compensation and sale consideration shall be initiated. He also submits that after due proceedings the amount will be deposited to the Land Acquisition
4 Officer/SDO (Revenue), Saraipali, as early as possible within a period of one month.
6. In view of above submission, the learned counsel for the petitioners submits that they will cooperate with the aforementioned proceedings.
7. Considering the submissions of learned counsel for the parties, instead of keep the present petitions pending, these writ petitions are disposed of without entering into merits of the case and respondent NHAI is directed to complete the execution of the sale-deed and other proceedings proposed by the concerned SDO (Revenue) and accepted by the petitioners as early as possible.
8. Both parties shall cooperate with each other to ensure the compliance/payment of compensation without further delay.
9. Let the aforementioned exercise be completed as expeditiously as possible and the compensation amount shall be deposited by the respondent NHAI before the Competent Authority within one month from today.
