Ashraful Haq Ms. Tapati Sarkar ..for respondent nos. 9 to 12. Ms. Susmita Dey (Basu) ..for the State The petitioner alleges that respondent nos. 8 to 13 have undertaken unauthorized construction. Learned counsel for the petitioner submits that such construction has been carried out on Government land, thereby obstructing the petitioner’s free ingress to and egress from his agricultural land. Pursuant to the directions of this Court, both parties have produced photographs of the alleged construction. Upon perusal of the photographs, it appears that no recent construction activity is presently being carried out at the site. Certain pillars appear to have been erected long ago. Learned counsel appearing for respondent nos. 9 to 12 submits that Title Suit No. 271 of 2022 is pending before the learned Civil Judge (Junior Division), Domkal, Murshidabad. It is further submitted that, in compliance with the injunction order passed in the said suit, the said respondents have refrained from undertaking any further construction. Mr. Golam Mastafa, learned counsel appearing for the petitioner, has drawn the attention of this Court to page 21 of the writ petition to indicate that the Pradhan of Herampur Gram Panchayat, respondent no. 7, had already issued a stop-work notice against the said respondents in the year 2022. In view of the aforesaid circumstances, no useful purpose would be served by keeping the writ petition pending. Accordingly, the writ petition is disposed of with a direction upon the Pradhan of Herampur Gram Panchayat, respondent no. 7, to ensure that no further unauthorized construction is undertaken by any party at the premises in question. Accordingly, WPA 2600 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
