According to the petitioner, the 1st respondent has issued the impugned summons dated 17.02.2026 without any authority under law. The petitioner further alleges that the 1st respondent, without conducting a proper enquiry and in an hurried manner, is attempting to dispose of the 4th respondent’s application for cancellation of the petitioner’s patta by passing a final order. Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of respondents 1 to 3 and on instructions, he submits that till date no final order has been passed by the 1st respondent on the 4th respondent’s representation. 4. In view of the above submission, no prejudice would be caused to any party if a direction is issued to the 1st respondent to conduct a fresh enquiry on the 4th respondent’s application seeking cancellation of the petitioner’s patta, after giving due consideration to the objections raised by the petitioner. 5. Since no adverse orders are passed against the 4th respondent in this writ petition, notice to the 4th respondent is dispensed with by this Court. 6. Accordingly, this writ petition is disposed of with a direction to the petitioner to submit written objections to the 1st respondent along with the supporting documents, in respect of the 4th respondent’s request for cancellation of the petitioner’s patta, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same within the stipulated time, the 1 st respondent shall consider the objections submitted by the petitioner, after hearing the submissions of the 4th respondent and after giving due consideration to the supporting documents produced by both parties, and https://www.mhc.tn.gov.in/judis WP No. 10786 of 2026 __________ Page4 of 5 thereafter, pass final orders on merits and in accordance with law within a period of twelve weeks thereafter. Before passing such final order, the 1st respondent shall furnish a copy of the representation / appeal submitted by the 4th respondent to the petitioner, seeking cancellation of the petitioner’s patta.
