The petitioner is seeking pre-arrest bail in connection with Talcher Excise Range P.R. Case No.108/2025-26 corresponding to 2(a)CC No.08 of 2026 registered for the alleged commission of offence punishable under Section 52(a)(i) of the Odisha Excise Act, pending in the Court of the learned S.D.J.M., Talcher. 3. Learned counsel for the petitioner, on instruction from the petitioner, submits that except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. 4. Learned counsel for the petitioner submits that the co-accused in the present case has already been granted regular bail. Hence, he seeks parity with the co-accused. 5. Although, I am not inclined to entertain the present bail application at this stage. However, the petitioner is directed to surrender before the trial Court on or before 15.05.2026 and move for regular bail application. If such bail application is filed by the petitioner before the trial Court, the same shall be considered on merit in accordance with law on the same day. 6. It is open for the petitioner to urge all the points as has been urged in the present petition including the ground of parity before the trial court. 7.
