Nos. 7 & 8 : Mr. Jitesh Kumar, Advocate. ------ 18/ 21.04.2026 This petition has been filed under Article 226 of the Constitution of India with a prayer for staying the construction of Panchayat Kuchhery Bhawan, being constructed on the raiyati land under Thana No. 41, Khata No. 147, Plot No. 1063, Mouza Dhuna, Thana Itkhori, District Chatra. 2. Learned counsel appearing for the State, on instruction, submits that now the said Panchayat Kuchhery Bhawan has already been constructed over the said land. 3. Learned counsel appearing for the petitioners submits that for the land in question, one suit, being Original Suit No. 05 of 2009 is pending before the learned court of Civil Judge (Jr. Div.), Chatra, in which, the petitioners have filed intervention petition and the said intervention petition has already been allowed. In view of the pendency of the aforementioned suit, he seeks permission to withdraw this writ petition with the liberty to take all the grounds in the pending suit, which are the subject matter of the present writ petition. 4. Learned counsel appearing for the State and learned counsel appearing for the respondent Nos. 7 and 8 have got no objection in that regard. 5.
