02/22.04.2026 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Rajmahal P.S. Case No. 175 of 2021, registered for the offence under Sections 147, 148, 149, 341, 323, 307, 342, 427, 354 506 and 504 of the Indian Penal Code and Section 8 of the POCSO Act pending in the court of learned Special Judge (POCSO Act), Sahibganj.

Learned counsel appearing for the petitioner submits that the allegations are there against 400 to 500 persons of trying to enter into the house of the informant and false allegation of molestation is also made and there are general and omnibus allegation against the petitioner. He further submits that the petitioner has got no criminal antecedent as disclosed in para 8 of the petition. He also submits that the co-accused on identical situation, has already been granted anticipatory bail in A.B.A. No.6484 of 2025 and A.B.A. No.204 of 2026.

Learned counsel appearing for the State has opposed the prayer and submits that the allegations are there of trying to enter into the house of the informant.

Looking to the contents of the FIR it transpires that there is allegation against 400 to 500 persons of assembling in the village and allegation of entering into the house of the informant is there against ten persons and there are general and omnibus allegations against the accused persons and two of the co-accused persons have been granted anticipatory bail in the aforesaid A.B.As. and the petitioners have got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, both the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Special Judge (POCSO) Act, Sahibganj, in connection with Rajmahal PS Case No.175 of 2021, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
