W.P.No.40520 of 2025 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 06.01.2026 Coram The Honourable Mr.Justice Abdul Quddhose W.P.No.40520 of 2025 KANNUSAMY ..Petitioner Vs. 1 THE DISTRICT COLLECTOR O/O. DISTRICT COLLECTOR, KALLAKURICHI DISTRICT. 2 THE REVENUE DIVISIONAL OFFICER, O/O. REVENUE DIVISION OFFICE KALLAKURICHI REVENUE DIVISION, KALLAKURICHI DISTRICT. 3 THE THASILDAR O/O. KALLAKURICHI THASILDAR, KALLAKURICHI DISTRICT. ...Respondents Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd and 3rd respondents to issue patta in Survey No.170/7 at Vengaivadi Village Kallakurichi Taluk and District in pursuant to the petitioner’s representation dated 29.07.2024 and consequently fix the time frame to dispose of the representation dated 29.07.2024. For Petitioner : Mr.P.Muthamizh Selvakumar For Respondents : Mr.D.Ravichander Special Government Pleader 1/4 https://www.mhc.tn.gov.in/judis W.P.No.40520 of 2025 Order The petitioner seeks for issuance of patta in his name for the property morefully described in the affidavit filed in support of this Writ Petition. 2. The learned Special Government Pleader for respondents, on instructions, would submit that the subject land is a Government land and therefore, patta cannot be issued in favour of the petitioner. The said fact is also not disputed by the petitioner, but, the petitioner contends that since the neighbouring landowners having already been granted patta, the petitioner is also entitled for patta. The petitioner has not produced any documents before this Court to substantiate the said contention. When admittedly, the land morefully described in the affidavit filed in support of this Writ Petition, is a Government land, the question of grant of patta in favour of the petitioner does not arise. Hence, this Writ Petition is not maintainable. Since the petitioner claims that he is in possession of the proeprty even now, it is made clear that the respondents can evict the petitioner only by following due procedure established under law, if the petitioner is found to be in possession of the property. Since this Writ Petition is not maintainable, however, is disposed of with the aforesaid direction. 2/4 https://www.mhc.tn.gov.in/judis W.P.No.40520 of 2025 06.01.2026 sd Index : yes/no Neutral Citation : yes/no To 1 THE DISTRICT COLLECTOR O/O.
