Petitioner has challenged the impugned order dated 02.11.2023, annexure-4 to the writ petition, whereby representation of the petitioner seeking transfer to an accessible area has been rejected.

It is contended by learned counsel for the petitioner that, in the said rejection order, it has been stated that petitioner cannot be transferred to an accessible area for the reason that there is no vacancy for the post of Assistant Teacher, L.T. Grade (English) in any of the six schools enumerated in the representation.

He further contended that he has filed a supplementary affidavit on 05.01.2025, wherein it has been mentioned that, in view of the transfer of Smt. Asha Joshi, Assistant Teacher, L.T. Grade (English), from P.M. Shri GGIC, Kaladhungi, Nainital, a vacancy has arisen, and now, the petitioner can be accommodated there.

Learned counsel for the respondent/State submits that the order annexed as annexure-1 to the

2026:UHC:5465 2 supplementary affidavit is dated 27.11.2024, which indicates the vacancy in the year 2024. There is no information regarding the fact as to whether such vacancy is still available or not.

Having considered the rival submissions of the parties and upon perusal of the record, writ petition can be disposed of finally by permitting the petitioner to make a fresh representation to respondent no.4. If such representation is filed by the petitioner within a period of ten days from today, the said representation shall be considered and decided by respondent no.4 within a period of four weeks from the date of receipt of such representation, and the petitioner shall be posted if the vacancy on the post of Assistant Teacher, L.T. Grade (English) is still available at P.M. Shri GGIC, Kaladhungi, Nainital.

Pending applications, if any, stand disposed of accordingly.
