The petitioner is apprehending his arrest in connection with Manjhiaon P.S. Case No. 134 of 2025, registered for the offence under Section 85 of Bharatiya Nyaya Sanhita, 2023 and Section 3/4 of Dowry Prohibition Act, pending in the court of learned Additional Chief Judicial Magistrate, Garhwa. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be the husband of the informant and it has been alleged that her husband was living at the place of posting along with another girl and after knowing that, she has come at Garhwa and lodged the FIR. He next submits that subsequently the dispute has also been settled and the settlement aspect has also come in the order of the learned Sessions Judge. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner happened to be the husband of the informant and allegations are there of keeping another girl. He next submits that the allegation of demand of dowry is also there against the [2026:JHHC:11701] -2- petitioner. 5. In the order of the learned Sessions Judge, the mediation aspect has come and the petitioner is said to be the husband of the informant and there is delay of two days in lodging of the FIR by the informant, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
