The present appeal has been filed under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. 2. In pursuance of the order dated 18th April, 2026, Mr. Jai Prakash Narayan Chowdhary, Dy. S.P. (HQ), Godda is present before this Court. 3. Heard learned counsel for the appellant, learned counsel for the State, learned counsel for the victim and the Investigating Officer. 4. The appeal has been filed against the impugned order dated 11.09.2024 passed by the learned Additional Sessions Judge-1st, Godda in A.B.P. No.502 of 2024 in connection with SC/ST P.S. Case No.12 of 2023, registered for the offence under Sections 341, 323, 504 and 506 read with Section 34 of the Indian Penal Code and under Sections 3(1)(r), 3(1)(s) and 3(1)(g) of the SC/ST (PoA) 2026:JHHC:11989 Page | 2 Criminal Appeal (S.J.) No.798 of 2024 Act. The case is presently pending in the court of the learned Additional Sessions Judge-1st, Godda. 5. It has been submitted by the learned counsel for the appellants that it is false and frivolous case and it is nothing but a land dispute. Further, the disputed land is in the possession of the accused person. Even the concerned Sub-Divisional Officer has given the possession of the said disputed land as per the direction of the Court. Thus, the victim, after losing the civil suit, has taken recourse to this criminal case for settle the score regarding the civil dispute. On the above basis, it has been submitted that no offence under SC/ST (PoA) Act is made out rather it is misuse of the protective provision. 6. On the other hand, learned counsel for the State and the victim have opposed the prayer for anticipatory bail but could not dispute the above factual matrix of the case. 7. Considering the above facts, the appellants, above named, are directed to surrender in the court below within four weeks from the date of receipt/ production of the copy of this order and in the event of their arrest or surrender, they shall be enlarged on bail, on their furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-1st, Godda in connection with SC/ST P.S. Case No.12 of 2023 on the conditions as laid down under Section 482 B.N.S.S., 2023. Further, the appellants will submit self-attested photocopies of their Aadhaar Cards and also submit their mobile number before the learned court below which they will always keep active and will not change it during pendency of this case without prior permission of the court. 8. In the result, the instant appeal stands allowed and disposed of. 9. Personal appearance of Mr. Jai Prakash Narayan Chowdhary, Dy. S.P. (HQ), Godda is hereby dispensed with. (Rajesh Kumar, J.)
