1. These second bail applications under Section 483 of BNSS have been filed on behalf of the petitioners, who have been arrested in connection with FIR No.38/2023 registered at Special Police Station (SOG), District ATS and SOG for offences punishable under Sections 419, 420, 467, 468 & 120B of IPC and Sections 3 & 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.

The first bail applications filed on behalf of petitioners were dismissed as withdrawn by this Court vide order dated 24.03.2026 while giving liberty to renew the prayer for bail before the learned trial Court after submission of result of investigation. After filing of charge-sheet, petitioners filed bail applications before the learned trial Court and same were dismissed vide order dated 18.05.2026 thus, these second bail applications have been preferred on behalf of the petitioners.

Learned counsel for the petitioners submit that petitioners have falsely been implicated in this case. Counsel submit that co- accused persons namely, Vimla Vishnoi, Rajendra Kumar, Ashok Kumar, Satayprakash, Anil Kumar Meena, Surat Ram Meena,
[2026:RJ-JP:22747] (3 of 4) [CRLMB-8180/2026] Dinesh Kumar son of Shri Babulal, Dinesh Kumar son of Shri Aasuram Vishnoi & Sampat Lal have already been granted benefit of bail by co-ordinate Bench of this Court as well as this Court. It is submitted that trial will take considerable time in its conclusion. Counsel submit that the petitioners are in custody since their date of arrest and further custody of the petitioners would not serve any fruitful purpose.
4. Learned Public Prosecutor opposes the submissions made by
learned counsel for the petitioners.
5. I have considered the contentions.

Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the parties, especially considering the fact that charge- sheet has been filed in this matter, also considering the fact that aforesaid co-accused persons have already been granted benefit of bail by co-ordinate Bench of this Court as well as this Court and trial will take considerable time in its conclusion, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow these second bail applications.

These second bail applications are accordingly allowed and it is directed that accused-petitioners- (1) Nivas Kurada S/o Shri Vagaram, (2) Mahesh Kumar Vishnoi S/o Shri Jagdish Vishnoi, (3) Sahi Ram S/o Shri Hanumana Ram & (4) Hanumanaram S/o Tejaram shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial Court with the stipulation that
[2026:RJ-JP:22747] (4 of 4) [CRLMB-8180/2026] they shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
8. However, it is made clear that the petitioners shall not involve in any other offence(s) during currency of the bail granted by this Court.
9. If breach of this condition is reported or comes to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to the petitioners by this Court.
10. The observations made hereinabove are only for decision of the bail applications and would not have any impact on the trial of the case in any manner.
