The petitioners are apprehending their arrest in connection with Chanho P.S Case No.92 of 2023, for offence registered under section 414/34 of Indian Penal Code and Section 30(ii) of Coal Mines Act, pending in court of learned Judicial Magistrate, Ranchi.

Learned counsel for the petitioners submits that that allegations are made that three motorcycles were loaded with three quintals of coal on each of the motorcycle and the petitioners happened to be the owners of the motorcycles. He also submits that the said coal was being taken for personal use and the petitioners are having no criminal antecedent as disclosed in paragraph no.19 of the petition.
4. Learned State counsel opposes prayer and submits that

illegally the said coal was being carried on the said motorcycles.

Considering that the petitioners were carrying the said coal for their personal use and they are having no criminal antecedent as aforesaid, and in that view of the matter, the petitioners, above named, are, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release the petitioners, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper.
6. A.B.A. No.1824 of 2026 is disposed of.
