Matter is heard in presence of the learned advocates representing the State respondents and Union of India. 2. Petitioner appears in person who has ventilated his grievance of extortion, misdeeds and illegal acts on the part of ruling dispensation which is not expected of welfare State and a democratically elected Government. 3. By sending a letter dated 19th January, 2024 addressed to the concerned authorities petitioner made a prayer for holding rally as well as to conduct carnival which would cover throughout the State from Digha to Cooch Behar. 4. For not granting permission petitioner has approached this Court seeking issuance of mandamus directing the concerned respondent authorities and administration to permit the petitioner to conduct such programme. 5. On perusal of the application which is an email letter it transpires that same was preferred far back on 19th January, 2024. Today when the Court is considering such application already assembly election in the State of West Bengal has been declared and dates are fixed on 23rd April, 2026 and 29th April, 2026. 6. Considering the ensuing assembly election Court is not inclined to direct the concerned police authorities to permit the petitioner to hold rally or carnival which would cover entire State from Digha to Cooch Behar. 7. In view of aforesaid scenario, at this stage no relief can be granted to the petitioner. 8. The writ petition stands dismissed. 9. However, in future after formation of new Government pursuant to ensuing assembly election if petitioner desires to hold a programme at local level in that event same shall be considered by the respondent authorities in accordance with law, based on application, if made. 10. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.) 2
