The petitioners are apprehending their arrest in connection with Rajabhitha P.S. Case No. 01 of 2026, registered for the offence under Sections 317(4), 317(5) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Godda. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case. She next submits that the name of the petitioners has come only on the basis of confessional statement and further the petitioners are nothing to do with the stolen motorcycles. She further submits that the allegations are made against these petitioners to facilitate in selling of the stolen motorcycles. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioners appear to be the accomplice of [2026:JHHC:12448] -2- the said gang, who is involved in stealing the motorcycles. 5. Considering that the allegations are made against these petitioners to facilitate in selling the stolen motorcycles and the name of the petitioners has come on the basis of confessional statement and in the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners, above named.
