Mr. Malay Bhattacharya Mr. Madan Mohan Roy Mr. Subhrojyoti Ghosh …for the petitioner Mr. Arindam Sen Ms. Sayanti Santra … for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. There was a scuffle between relatives. No grievous injury was caused. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the injury report, which show cut injury inflicted on the scalp, which required four stitches for repair. The name of the present petitioner has been specifically taken in the injury report as the principal assailant. He also relies on the statement of the victim and other witnesses. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
