ORDER 27.04.2026
Order No.
01.
1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard learned counsel for the Petitioners and learned Additional Standing Counsel for the State. Perused the records.
3. This is an application under Section 482 of the B.N.S.S., 2023 filed by the Petitioners for anticipatory bail, involving offence punishable under Sections 324(2)/296/351(2)/74/3(5) of B.N.S. in C.T. Case No.66 of 2026 in the Court of learned Civil Judge Junior Division-cum-J.M.F.C., Baripal arising out of Ramchandrapur P.S. Case No.66 of 2026.
4. It is stated by the learned counsel for the Petitioners that due to a motor vehicle accident that took place between the two neighbouring families, the Petitioners have been falsely implicated in the present case. He further submitted that the injured has not sustained any grievous injury. Learned counsel for the Petitioners
Page 2 of 3. has also contended that since the Petitioners belong to the locality, there is no chance of absconding. Learned counsel for the Petitioners further submitted that the Petitioners do not have any criminal antecedents and that they are ready and willing to abide by any stringent terms and conditions imposed by this Court.
5.
Learned counsel for the State, on the other hand, objected to the release of the Petitioners on bail on the ground that since the investigation is still on, the release of the Petitioners at this juncture would cause a delay in conclusion of the investigation.
6. At this stage, learned counsel for the Petitioners submitted that the Petitioners do not want to press this bail application and seek liberty to surrender before the court below and move an application for bail.
7. Considering the seriousness of the allegation, gravity of the offence and the facts of the case, although I am not inclined to grant anticipatory bail to the Petitioners, however it is observed that, in the event the Petitioners surrender and move for bail before the learned court in seisin over the matter within a period of three weeks from today, they shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper. Violation of any of the terms and conditions shall entail cancellation of the bail.
8. It is further directed that the bail granted to the Petitioners shall be subject to depositing a cash security of Rs.2,000/- (Rupees Two Thousand) each before the learned Court in seisin over the matter, which shall be kept in any Nationalized bank in interest bearing account initially for a period of one year which will be

9. It is further directed that the bail granted to the Petitioners shall be subject to the verification of their criminal antecedent. In the event, the Petitioners are having more than one similar criminal antecedent and the other Petitioners are having any similar criminal antecedents, then this order shall stand automatically revoked.
10. The ABLAPL is disposed of accordingly.
