p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.1595 of 2026 Ashok Naik @ Muna … Petitioner Mr.A.Mishra, Advocate along with Mr.S.P.Mishra, Advocate -versus- State of Odisha … Opposite Party Mr. S.C.Pradhan, Addl. PP CORAM:JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 22.04.2026 01. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Banki PS Case No.320 of 2023 corresponding to ST Case No.34 of 2024 pending in the file of learned 1st Addl. Sessions Judge, Cuttack for commission of offences punishable U/S. 302 of IPC, on the main allegation of committing murder of one Kabu Bhoi. 2. Heard, Mr.Arijeet Mishra, learned counsel appearing along with Mr.Siba Prasad Mishra for the petitioner and Mr. S.C.Pradhan, learned Additional Public Prosecutor in the matter and perused the record together with the copy of deposition of PWs. 1 to 5. 3. Admittedly, the petitioner is renewing his prayer for bail after examination of witness PW2-Babuli Bhoi and PW5-Kulu Jena, but PW5 has become hostile to the prosecution case, however, the evidence of PW2 reveals him to be a witness to the extra judicial confession. Further, the petitioner is in custody since 12.09.2023 and in the meantime, only five witnesses have been examined, however, the trial is yet to be concluded. In the aforesaid facts and situation and the case being based on p. 2 circumstantial evidence and taking into account the materials so placed on record together with the evidence of witnesses so far examined, this Court without expressing any view on merits admits the petitioner to bail. 4. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy) Judge kishore
