The petitioner, above-named, who is in custody since 18.11.2025 has prayed for regular bail in connection with Dhanbad P.S. Case No. 378 of 2025 for the offence registered under Sections 190/ 191(1) / 190(2) / 190 (3)/ 109/ 115(2) / 121 (1)/ 121(2) / 125/ 132 / 324 (4)/ 351/ 352 of BNS, 2023 and under Section 3 of the Prevention of Damage to Public Property Act, 1984. As per the case of prosecution, the accident took place on 24.10.2025 and three injured persons were admitted in Asharfi Hospital and one of them died during course of treatment. After the death, about 60-70 persons variously armed with deadly weapon, ransacked the Hospital and when the Police went there to maintain law and order, they resorted to indiscriminate pelting of stones causing damage to public property and also injuries to the Police personnel. It is submitted by the learned counsel on behalf of petitioner that offence under Section 109 BNS, 2023 is not made out as none was critically injured in the alleged incidence and the petitioner is in custody for more than 2 months. It is submitted that the petitioner is also critically ill and he was shifted from P.M.C.H., Dhanbad to RIMS, Ranchi for better treatment. Learned A.P.P. for the State has opposed the prayer for bail. It is submitted that he was identified to be involved in the incident on the basis of CCTV Footage. Considering the same, the above-named petitioner is directed to be released on bail on Cash Deposit of Rs.25,000/- [Rupees Twenty 2026:JHHC:2346 2 Five Thousand] and on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
