However, due to some matrimonial discord, she left the house and got married to someone else. The present case has been initiated as a false case of abetment of suicide. Learned counsel for the State opposes the prayer for anticipatory bail, refers to the FIR, the statements of witnesses and the post-mortem port and submits that the marriage between the present couple had taken place seven years ago. Therefore, the petitioner would know the mental condition of the victim very well. The petitioner simply left the husband and got married to another person without getting divorce. Thereafter she sent pictures and videos of the marriage to the victim through whatsapp. After receiving 2 all this, the victim allegedly became depressed and finally committed suicide. This is not a simple case where the wife deserts the husband and gets married again, without giving divorce or not. She had been married to the victim for seven years and would therefore, know about the mental condition of her husband. Yet, she decided to send pictures and videos of her marriage to a friend of the victim to the victim through whatsapp. Immediately thereafter, the victim allegedly committed suicide. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
