Khan with Ms. Rekha Jain HON'BLE MR. JUSTICE SAMEER JAIN Order 22/05/2026 Learned counsel for the petitioners has submitted that petitioners are students who are in a trapped situation on account of certain litigations and deficiencies. The Institute wherein the petitioners are enrolled is in a state of dilemma and they are not [2026:RJ-JP:21708] (2 of 3) [CW-4915/2026] very clear about the fact whether the Institute will be operational in future or not, leaving the entire carrier of the students at stake. Learned counsel for the petitioners has placed reliance upon the order dated 24.03.2026 passed by the Coordinate Bench of the Court at Principal Seat, Jodhpur in S.B. Civil Writ Petition No. 5413/2026, titled Bhumika Goswami & Ors. v. State of Rajasthan & Ors., and submitted that liberty was granted to the petitioners therein to file representation. To substantiate the claim for parity, the relevant portion of the said order dated is reproduced as under: “6. Looking to the fact that petitioners have already undergone the studies up to IInd Semesters and to safeguard their future prospects, this Court deems it appropriate to dispose of the writ petition, while directing the respondent-University to first declare the result of petitioners of Ist Semester of B.Sc. Nursing Course. 7. The petitioners are at liberty to file a representation within a period of 10 days to the respondent-University requesting to transfer them to any other college having the vacant seats of B.Sc. Nursing-2024-2025 Batch. 8. In case, any representation is filed, the respondent- University shall first declare the result of petitioners of Ist Semester of B.Sc. Nursing Course and also the respondent-University shall consider and decide the request for transfer of petitioners to any other college within a period of 15 days thereafter, while taking into account the fact that petitioners have already completed Ist Semester and studies/classes of IInd Semester.” It is submitted that the present matter possesses an akin factual matrix and identical narrative to that of Bhumika Goswami & Ors. (supra), therefore, it is prayed that equal directions may be passed in the present case to maintain parity. Heard. [2026:RJ-JP:21708] (3 of 3) [CW-4915/2026] Mr. M. A. Khan has put in appearance on behalf of the respondent-University. In light of the aforesaid submissions, it is directed that the equivalent directions, as encapsulated in the order dated 24.03.2026 passed in Bhumika Goswami & Ors. (supra), shall be made applicable mutatis mutandis qua the petitioner herein. Accordingly, the present petition stands disposed. Pending applications, if any shall stand disposed.
