The petitioner is apprehending his arrest in connection with Pratappur PS Case No.85 of 2025, for offence registered under section 274, 275, 3(5) of BNS, 2023 and section 47(a) of Excise Act, pending in court of learned S.D.J.M., Chatra. 3. Learned counsel for the petitioner submits that the name of the petitioner has come on confessional statement of the co- accused and the allegations are made of recovery of foreign liquor from the Scorpio vehicle and the petitioner happened to be owner of the said vehicle, however, the wife of this petitioner is the owner of the said vehicle and she has already been granted anticipatory by this Court in ABA No.885 of 2026. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.14 of the petition. 4. Learned State counsel opposes prayer and submits that the 2026:JHHC:11869 2 petitioner happened to be the husband of the owner of the vehicle in question. 5. Considering that the vehicle in question is not in the name of the petitioner and the same is in the name of Shilpa Kumari and she has been granted anticipatory bail and the petitioner is having no criminal antecedent as aforesaid, and in that view of the matter, the petitioner, above named, is, hereby, directed to surrender before learned court within two weeks from today, and the learned court shall release the petitioner, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper. 6.
