JUSTICE PARTHIVJYOTI SAIKIA O R D E R 08.06.2026 Heard Mr. F. Haque, the learned counsel appearing for the petitioners. Also heard Mr. K.K. Parasar, the learned Addl. Public Prosecutor, Assam. 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioners, namely- (1) Rashidul Islam @ Rosedul Islam, (2) Sahanur Ali and (3) Sanidul Islam @ Samidul have prayed for releasing them on bail after they were arrested in connection with Abhayapuri Police station Case No.80/2026 under Sections, 331(4)/305/3(5)/112 of BNS, 2023 and added Section 13 of Assam Cattle Preservation Act, 2021. 3. Three numbers of cattle were stolen on 18.04.2026 from the house of Jinnah Uddin Ahmed. 4. The Forwarding Report shows that the cattle were stolen by a person called Raju Ali and these three petitioners were in contact with him. The three petitioners have already completed 39 days in judicial custody. 5. Under the given circumstances, this Court is of the opinion that the petitioners do not deserve to be detained in custody for any further period of time. Their bail application is allowed. 6. The petitioners, namely- (1) Rashidul Islam @ Rosedul Islam, (2) Sahanur Ali and (3) Sanidul Islam @ Samidul who were arrested in connection with Abhayapuri Police station Case No.80/2026 under Sections, 331(4)/305/3(5)/112 of BNS, 2023 and Page No.# 3/3 added Section 13 of Assam Cattle Preservation Act, 2021, shall be released on bail of ₹25,000/- each with sureties of like amount to the satisfaction of the learned Sub- Divisional Judicial Magistrate (M), North Salmara, Abhayapuri.
