1. The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.89/2015 registered at Police Station Pahadi, District Bharatpur for offences under Sections 147, 148, 149, 323, 341, 307 and 302 IPC, 1860.

2. Since both these bail applications arise out of common FIR, hence, they are being decided by this common order.
3. Heard learned counsels for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. It is contended by learned counsel for the petitioners that in the present matter, the petitioners have not been named in the FIR. There is no specific allegation against the petitioners of firing at the deceased Hamid and Hanif. It is further contended that co- accused Aslam was granted bail by Co-ordinate Bench of this Court vide order dated 03.09.2015. Co-accused Zahul was also granted the benefit of bail by Co-ordinate Bench of this Court vide
order dated 20.08.2015. Other co-accused Ayyub and Sahun were also granted the benefit of bail by Co-ordinate Benches of this Court vide orders dated 25.02.2021 and 18.03.2021 respectively. The case of the petitioners is on better footing. The petitioners are in custody since 08.04.2026. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and on the ground of parity with co-accused, the bail applications deserves to be allowed.
5. Learned Public Prosecutor has vehemently opposed the bail applications of the petitioners.
6. On consideration of the rival submissions and material available on record and in the light of submissions made by
learned counsel for the petitioners but without expressing any
[2026:RJ-JP:21360] (3 of 3) [CRLMB-6920/2026] opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Aameen S/o Chav Khan and Kasam S/o Akbar, be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
