1. Heard Mr. B. Chowdhury, learned counsel for the petitioner. Also heard Mr. Bankim Sharma, learned Special Public Prosecutor for the Wild Life Department. 2. This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of CR (F) Case No.05/2024 under Sections 9/39/48-A/51 of the Wild Life Protection Act, 1972, pending in the Court of the learned Sub-Divisional Judicial Magistrate (S), Lakhimpur, North Lakhimpur. 3. In a vehicle owned by the present petitioner, Riaz Uddin, wild animals were illegally being transported. The offence report was filed against the present petitioner. The offence is triable by the Court of Sessions. 4. The petitioner now apprehends that if he appears before the Court of the learned Sub-Divisional Judicial Magistrate (S), Lakhimpur, North Lakhimpur, he will be remanded to custody because this Court does not have the jurisdiction to entertain his application. 5. The petitioner submits that he is interested in facing the trial and, therefore, he deserves to be given an adequate opportunity to that effect. 6. I have heard the submissions made by the learned counsel of both sides. 7. This Court is of the opinion that since the petitioner is interested in facing the trial he deserves to be given an adequate opportunity to that effect. Therefore, his prayer is allowed. 8. The petitioner, Riaz Uddin is directed to appear before the Court of the learned Sub-Divisional Judicial Magistrate (S), Lakhimpur, North Lakhimpur in connection with the CR (F) Case No.05/2024 under Sections 9/39/48-A/51 of the Wild Life Protection Act, 1972 within a period of 15 (fifteen) days from today and on his appearance, he shall be allowed to go on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate (S), Lakhimpur, North Lakhimpur. 9.
