The instant criminal appeal is preferred by the appellant – Kartar Singh S/o Shri Ramchandra Singh, against the judgment and order passed by the learned Judicial Magistrate/Additional Civil Judge 2nd Kashipur, District Udham Singh Nagar dated 31.07.2023 passed in Complaint Case No.243 of 2013, “Kartar Singh Vs. Resham Singh” a proceeding under Section 138 of Negotiable Instrument Act, wherein the respondent was acquitted.
3. As per office report, there is a delay of 984 days in preferring the instant appeal. The delay condonation application (IA No.1/2026) has also been filed, but no reason has been given for delay except that the delay in preferring the appeal neither deliberate nor wilful or due to lack of knowledge and financial hardship, the appeal could not be filed within time.
4. The delay of 984 days admittedly is an inordinate delay, which has not been explained. Even otherwise, on perusal of the order passed by the Trial Court acquitting the respondent, it reveals that the Trial Court have dealt with all the relevant aspects, therefore, this Court does not find any merit in the appeal also.
5. In such view of the matter, the instant criminal appeal is dismissed on the ground of delay as well as on merit.
6. No order as to costs.
