Also heard Mr. M P Goswami, the learned Additional Public Prosecutor appearing for the State of Assam as well Page No.# 2/2 as Mr. S Barman, the learned counsel appearing for the respondent No.2. 2. This is an application under Section 528 of the BNSS, 2023 in respect of Sessions Case No. 59/2015 pending in the Court of the learned Assistant Sessions Judge, Nalbari. 3. The charge sheet was filed against Md. Farid Ali, Md. Anowar Ali and the present petitioner Ikram Ali @ Ekram Ali. After completion of trial, they were acquitted by the trial court. The present petitioner Ikram Ali @ Ekram Ali is an absconder and therefore, the trial court directed issuance of Non- Bailable Warrant of Arrest and P/A against the petitioner. 4. Now the petitioner wants to contest the case and prays that adequate opportunities should be given to him to that effect. 5. I have considered the submissions made by the learned counsel of both sides. 6. Having considered the submissions made by the learned counsel of both sides, this Court is of the opinion that since the petitioner is interested in facing the trial, he should be given adequate opportunities to that effect. 7. Therefore, this Criminal Petition filed by the petitioner is allowed. 8. The Non- Bailable Warrant of Arrest and P/A issued against the petitioner shall be recalled. 9. It is hereby directed that the petitioner, namely Ikram Ali @ Ekram Ali is directed to appear before the Court of the learned Assistant Sessions Judge, Nalbari within next 30 (thirty) days from today in respect of Sessions Case No. 59/2015. On his appearance, the petitioner Ikram Ali @ Ekram Ali shall be released on bail of ₹25,000/- (Rupees twenty five thousand) with a surety of like amount to the satisfaction of the Assistant Sessions Judge, Nalbari. 10. The petitioner shall regularly appear before the trial court on each and every date of hearing. If the petitioner fails to appear before the trial court, the trial court shall have the liberty to procure his attendance in accordance with the procedures as laid down by law. With the aforesaid direction, the Criminal Petition stands disposed of. JUDGE Comparing Assistant
