JUSTICE R.K. PATTANAIK Order No. ORDER 12.03.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Cyber Crime and Economic Offence, Kalahandi P.S. Case No.8 of 2025 corresponding to C.T. Case No.645 of 2025 pending in the file of learned S.D.J.M., Bhawanipatna on the grounds stated therein. 3. Perused the FIR as at Annexure-1. The copies of the chargesheet and order sheets of the learned court below are at Annexure-2 series. 4. Mr. Panda, learned counsel for the petitioner submits that the petitioner was arrested and earlier released on bail for the alleged offences being bailable in nature. In the meantime, chargesheet is filed with non-bailable offences included, hence, apprehends arrest in the hands of the local police and therefore, p. 2 he should be directed to surrender before the learned court below to go on bail with any conditions. 5. Learned counsel for the State produced the case diary, statement of the victim recorded under Section 183 BNSS and submits that the petitioner is responsible for the alleged mischief of sharing her objectionable photographs with a fake I.D. opened in the name of the informant. Since the investigation is concluded and the petitioner was on bail and in the meantime, there has been closure of investigation leading to the filing of the chargesheet on 28th September, 2025 and the petitioner is aged about 23 years claimed to be a student, recording the submission that only objectionable photographs have been released allegedly at his behest, this Court is of the view that he should be directed to surrender before the learned court below for being released on bail with stringent conditions imposed. 6. Accordingly, it is ordered. 7. In the result, ABLAPL is disposed of. It is further directed that in the event, the petitioner surrenders within a fortnight from today before the learned S.D.J.M., Bhawanipatna in connection with Cyber Crime and Economic Offence, Kalahandi P.S. Case No.8 of 2025 corresponding to C.T. Case No.645 of 2025, he shall be released on bail subject to him furnishing bail a bond of Rs.40,000/- (Rupees forty thousand) with one solvent surety for the like amount to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and p. 3 proper in the facts and circumstances of the case besides the following, such as, he shall not commit similar mischief while on bail and cause any harm to the informant in any manner whatsoever and to furnish an undertaking before the P.S. concerned in that regard. 8.
