JUSTICE R.K. PATTANAIK Order No. ORDER 22.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R. Case No.357 of 2026 pending in the file of learned S.D.J.M., Bhadrak arising out of Bhadrak Town P.S. Case No.89 of 2026 on the grounds stated. 3. Perused the FIR as at Annexure-1. It is submitted that the petitioner and informant belong to the Police Department. In so far as the FIR is concerned, it is alleged therein that the former said to have received an amount of Rs.3.7 lac from the latter and cheated him. But the submission is that the allegations are false. At the same time, it is submitted that the petitioner is inclined to deposit an amount of Rs.50,000/-. Recorded the submission of Mr. Panda, learned ASC for the State. Since the allegation is in relation to payment of an amount received by the petitioner and there has been no refund for nearly three years, hence, the FIR, this Court though not in favour of granting pre-arrest bail to him but is of the view that he should be directed to surrender before the learned court below for being released with conditions besides deposit of Rs.50,000/- payable to the informant. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned S.D.J.M., Bhadrak within fortnight from today, it is directed that he shall be released on bail in connection with G.R. Case No.357 of 2026 corresponding to Bhadrak Town P.S. Case No.89 of 2026 on furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed as deemed just and proper and in the facts and circumstances of the case and deposit of Rs.50,000/- to be kept in a fixed deposit with any nationalized bank renewable from time to time. 6.
