Petitioner/s Versus The State of Biharw ... ... Opposite Party/s ====================================================== Appearance : For the Petitioner/s : Mr. Randhir Kumar No 1 For the Opposite Party/s : Mr. Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 4 22-04-2026 1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. This application, for grant of anticipatory bail, arises out of Saharsa Police Station Case No. 726 of 2024, dated 21.07.2024, disclosing offences under Sections 318(4)/338/336(3)/3(5) and Section 10 of the Bihar Examination Control Act. 3. That the prosecution case, in brief, is that on 21.07.2024, during the Bihar Public Service Commission’s Teachers Recruitment Examination held at the Manohar Uchcha Vidyalaya, Sahrsa, examination centre, the informant, being the the Headmaster, reported suspected Patna High Court CR. MISC. No.2699 of 2026(4) dt.22-04-2026 2/3 irregularities during biometric verification. Upon verification, it was found that one Amresh Kumar was appearing in examination in place of Rajesh Kumar i.e. the petitioner having Roll No. 586745. 4. Learned counsel for the petitioner submits that the petitioner is innocent and is a bonafide candidate of TRE (Teachers Recruitment Examination) having Roll No. 586745, but he was absent on the date of examination due to illness and had no knowledge that one Amresh Kumar, was appearing in the examination on his behalf. He further submits that the petitioner moved twice for anticipatory bail before the subordinate court due to demise of her mother. He next submits that petitioner is having no criminal antecedent and he is a student with bright career ahead. 5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and seriousness of offence and the fact that co- accused Amresh Kumar was impersonating the petitioner at his behest and the anticipatory bail applications of the petitioner have been rejected twice by the subordinate court and thus attained finality, I am not inclined to grant Patna High Court CR. MISC. No.2699 of 2026(4) dt.22-04-2026 3/3 the petitioner privilege of anticipatory bail. 6. This application is, accordingly, dismissed. ashwani/- (Anil Kumar Sinha, J) U T
