1. Heard Mr. N. Gogoi, learned counsel for the petitioner. Also heard Mr. M. P. Goswami, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for quashing the orders directing NBWA against the petitioner, Bikash Bauri in connection with Sessions CHA Case No.97/2022, under Section 366 of the IPC arising out of Mothurapur P.S. Case No.61/2021, pending in the Court of the learned Sessions Judge, Charaideo. 3. The petitioner is an accused before the Trial Court. On some dates he was absent in the Court therefore, the Trial Court directed issued NBWA against the petitioner. 4. The petitioner submits that he lost communication with his lawyer and, therefore, the Trial Court directed issue of NBWA against the petitioner him. Now he submits that he is interested in facing the trial and, therefore, he deserves to be given an adequate opportunity to that effect. 5. I have heard the submissions made by the learned counsel of both sides. 6. This Court is of the opinion that since the petitioner is interested in facing the trial he deserves to be given an adequate opportunity to that effect. Therefore, his prayer is allowed. 7. All orders directing issue of NBWA against the petitioner, Bikash Bauri in
Page No.# 3/3 connection with Sessions CHA Case No.97/2022 are set aside. 8.
The petitioner, Bikash Bauri is directed to appear before the Court of the learned Sessions Judge, Charaideo in connection with the CHA Case No.97/2022 under Section 366 of the IPC arising out of Mothurapur P.S. Case No.61/2021 within a period of 15 (fifteen) days from today and on his appearance, he shall be allowed to go on fresh bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Sessions Judge, Charaideo, Assam. 9.
