GP FOR FORESTS The Court made the following: 2 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondent Forest Authorities in illegally digging trenches in the petition schedule DKT assigned land and attempting to take over the physical possession of the petition schedule property admeasuring Ac.4.72 cents in Sy.No.256 of Diguva Puttur Village, K.V.B. Puram Mandal, Tirupati District, without issuing any notice, without initiating any proceedings for cancellation of the original D-Form Patta, without resuming the assigned land in accordance with law and without following due process of law, as illegal, arbitrary, without jurisdiction and violative of Articles 14 and 300-A of the Constitution of India, and consequently direct the respondents not to interfere with the petitioner's peaceful possession and enjoyment of the petition schedule property except in accordance with law.” 2. Heard Sri G.Ravi Teja, learned counsel for the Petitioner, Ms.Baliboyina Sravani, learned Assistant Government Pleader for Forests and Ms.K.Vijayeswari, learned Assistant Government Pleader for Revenue. 3. Learned counsel representing both sides, in one voice, would submit that the Petitioner herein succeeded the property, since DKT patta was issued in favour of the maternal uncle of the Petitioner through which the Petitioner succeeded the property. It is submitted that pattadar passbook was also issued in the name of the Petitioner. 4. In the light of the submissions made, the Writ Petition is disposed of directing the Respondents – Authorities to follow due process of law regarding the subject property. There shall be no order as to costs.
