CRM (DB) 3514 of 2024
In the matter of : Abdul Mannan Mubarak
… Petitioner(s)
Ms. Faria Hossain, ld. APP Ms. Suparna Chatterjee
… for the State-respondent(s) Ms. J. Ray Mr. Anis Datta Sarma
… for the defacto-complainant(s)
None appears for the petitioner. Learned advocates for the defacto-complainant and State are present. The petitioners has challenged the order dated 07.08.2024 passed by the learned Sessions Judge, Alipore while granting bail to the accused/o.p. no.2. State has submitted a report which reflects that there was threat at the behest of the o.p. no.2 for withdrawing the case. An enquiry was conducted by the concerned officer of Narendrapur Police Station who found that the accusation of threat and coercion were not substantiated. Having considered the passage of time which has passed in the meantime since the petitioner was granted the liberty of bail, I am not inclined to interfere with the said order at this belated stage. However, this will not prevent the petitioner from approaching the learned jurisdictional court, if there is misuse of liberty committed by the accused persons by deterring the progress of the proceedings.
2 With the aforesaid observations, CRM (DB) 3514 of 2024 is disposed of. Report submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
