The instant criminal misc. application has been submitted for recalling of the order dated 03.12.2025 passed by this Court by which S.B. Criminal Misc. Petition No.5589/2023 submitted by the petitioner was dismissed for want of appearance of the counsel for the petitioner. 2. Learned counsel for the applicant submits that on account of personal urgent work, he was out of station, hence, he could not appear before the Court when the matter was called and therefore, the aforesaid misc. petition was dismissed for want of prosecution. Learned counsel further submits that important questions of law and facts are involved in the aforesaid misc. petition, which is required to be decided on its merits. (2 of 2) [CRLMA-67/2026] 3. For the reasons stated therein, the application stands allowed. The order dated 03.12.2025 passed by this Court in S.B. Criminal Misc. Petition No.5589/2023 stands recalled and S.B. Criminal Misc.
