Learned counsel for the petitioner submits that the petitioner is in custody since 28.10.2025 in connection with Nala P.S. Case No.56 of 2025 corresponding to Special POCSO Case No.01/2026, registered under Section 96, 3 (5) of B.N.S., 2023, now pending in the court of learned Special Judge, POCSO Act, Jamtara. 3. The learned counsel for the petitioner has submitted that the statement of the victim recorded under Section 183 BNSS has been placed on record by way of supplementary affidavit. He submits that she has stated before the court that she suo moto eloped with the petitioner and went to Kolkata and wanted to marry the petitioner. 4. The learned counsel for the State has opposed the prayer and submitted that as per the F.I.R., she was 16 years of age. 5. To this, the learned counsel for the petitioner has submitted that there is no allegation of any sexual assault by the victim in her statement recorded under Section 183 BNSS. 6. After hearing the learned counsels for the parties and in view of the statement made by the victim under Section 183 BNSS and the custody of the petitioner since 28.10.2025, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/-(Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO Act, Jamtara in connection with Nala P.S. Case No.56 of 2025 corresponding to 2026:JHHC:12354 2 Special POCSO Case No.01/2026, on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned trial court. 7. The instant application is allowed with the aforesaid conditions. 8.
