Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner challenging the show cause Notice dated 26.07.2021 2 (Annexure P-1) issued by Sub Divisional Officer (Revenue), Gariaband, District - Gariaband (C.G.) in Revenue Case No. 202010220300067/A-Year 2019-20. 3. Learned counsel for the State has filed its reply. 4. Learned counsel for the State while referring to its reply submits that aforesaid revenue case has now attained its finality and vide order dated 01.08.2023 (Annexure R/1) diversion order dated 02.12.2023 passed by S.D.O. (Revenue), Gariaband has been cancelled, therefore, this petition has become infructuous. 5. Aforesaid facts has also been conceded by counsel for the petitioner. 6. Having considered the contention putforth by counsel for the parties, particularly considering the reply filed by the State, since show-cause notice (Annexure P-1) dated 26.07.2021 has been issued at the initial stage of aforesaid revenue case and as of now, revenue case has attained its finality and final order has been passed on 01.08.2023 by Sub Divisional Officer (Revenue), Gariaband and diversion order dated 02.12.2020 passed by S.D.O. (R) (Gariaband) has been cancelled. Therefore, in aforesaid situation, this petition has become infructuous. 7. Accordingly, the writ petition is dismissed as having become infructuous.
