The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.16/2023, registered at Police Station Mandawar (Dausa), District Dausa, for the offence(s) under Sections 147, 148, 149, 323, 341, 336, 451, 307, 302, 506 and 120-B of IPC and Sections 3/25 and 3/27 of the Arms Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case as the name of the accused-petitioner is not mentioned in the FIR. It is contended that the FIR was lodged against 23 persons and supplementary charge-sheet was submitted against the accused- petitioner on 20.12.2025. It is alleged against the accused- petitioner that he pelted stone at the injured, however, the main [2026:RJ-JP:19072] (2 of 3) [CRLMB-6247/2026] accusation of causing death of the deceased by using firearm is against the other co-accused namely; Akbar, Sunil and Rameshwar. It is also contended that the other co-accused Akbar and Sunil have been enlarged on bail by the Hon'ble Apex Court vide order dated 20.07.2026 and 03.07.2024 respectively and bail of the other co-accused Rameshwar was granted by the Co- ordinate Bench of this Court vide order dated 26.03.2025. It is further contended that the case of the accused-petitioner is akin to that of the other co-accused namely Mahesh, Banne Singh, Sunita, Keshwati, Kaushalya, Kumari Asha and Ramratan Yogi. It is argued that the accused-petitioner is in custody since 20.12.2025, there is long list of 92 witnesses cited by the prosecution and further the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the material available on record. 5. It is not desirable to express anything on the merits of this case. The main co-accused against whom there are allegations of causing death of the deceased by using firearm have already been enlarged on bail by the Hon'ble Apex Court and the Co-ordinate Bench and other similarly placed co-accused namely; Mahesh, Banne Singh, Sunita, Keshwati, Kaushalya, Kumari Asha and Ramratan Yogi have also been enlarged on bail by the Co-ordinate Bench vide order dated 24.04.2023 and 21.09.2023 respectively and the case of the present petitioner is not distinguishable from [2026:RJ-JP:19072] (3 of 3) [CRLMB-6247/2026] that of the other co-accused, therefore, this Court deems it just and proper to enlarge the accused-petitioner on bail. 6. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner- Vijay Yogi S/o Badriprasad, in connection with FIR No.16/2023, registered at Police Station Mandawar (Dausa), District Dausa, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
