For the State The husband of the first petitioner was appointed as Gram Panchayat Karmee of Gurap Gram Pannchayat and died in harness on 2nd December, 2017. Despite completing all pension related formalities within due time, pension payment order was issued by the concerned authority on 17th July, 2018. The gratuity amount and arrear pension were disbursed on 1st August, 2019. The petitioners seek interest on the gratuity amount and arrear pension paid to him due to delay in disbursal of the same. Upon consideration of the submission made on behalf of the parties and material on record, the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and the Treasury Officer, Hooghly I, being the 3rd and 4th respondents herein, are directed to pay interest to the petitioners at the rate of 8% per annum on the gratuity and arrear pension amount calculated from 3rd December, 2017 till the date of actual payment. Such 2 payment shall be made within two months from the date of communication of this order. The writ petition is accordingly disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
