W.P.(C) No.5869 OF 2026
Nirakar Samal …. Petitioner Ms. Deepali Mahapatra, Advocate -versus- State of Odisha and others …. Opp. Parties
Mr. Bibekananda Nayak, Additional Government Advocate (for Opposite Party No.1)
CORAM:
JUSTICE K.R. MOHAPATRA
JUSTICE SANJAY KUMAR MISHRA
ORDER
Order No. 22.04.2026
1.
1. This matter is taken up through hybrid mode.
2. The matter was listed at serial No.11 of the cause list of Hon’ble the Chief Justice. On being mentioned by the
learned counsel for the Petitioner pursuant to the notice published, the matter is taken up by this Bench.
3. The grievance of the Petitioner in this writ petition is to provide the approved layout plan and necessary site demarcation for construction of Mini Town Hall-cum-Urdu Library in Ward No.17 under Bhadrak Municipality.
4. It is submitted by Ms. Mahapatra, learned counsel that the Petitioner being the successful bidder was issued Work
Order vide letter dated 11th August, 2025 (Annexure-2) by the Executive Officer, Bhadrak Municipality. 4.1. In the said Work Order, the Petitioner was requested to start the work within seven(7) days and to complete the same as per the terms and conditions of the said agreement. The Petitioner was also requested therein to contact the Municipal
Engineer & Assistant Engineer of the concerned section regarding execution of the work and to submit the work programme to the Executive Officer, Bhadrak Municipality. The Petitioner was also instructed that if he fails to start the work within seven (7) days from the date of receipt of the Work Order, it would be presumed that he is not interested to execute the work and the Work Order issued in his favour would be cancelled. 4.2. It is submitted that as per the terms and conditions of the agreement, the Petitioner was to complete the work within 330 days of issuance of Work Order. But, the Petitioner has not yet been provided with the approved layout plan and demarcated site. Though the Petitioner had raised his grievance for supply of the approved plan and demarcated site on several occasions under Annexure-3 series, but, the Executive Officer, Bhadrak Municipality has not yet responded to the same. She, therefore, submits that the Petitioner finding no other alternative has filed the present writ petition seeking for the aforesaid relief. 5. Taking note of the submissions made by the learned counsel for the Petitioner and the innocuous nature of the prayer made by the Petitioner in the writ petition, this Court, without delving into the merit of the case, disposes of the writ petition with a direction to the Executive Officer, Bhadrak Municipality to consider the Petitioner’s grievance petition under Annexure-3 series, as expeditiously as possible, preferably within a period of one (1) month and communicate the decision thereof to the Petitioner forthwith. 6. Ms. Mahapatra, learned counsel for the Petitioner undertakes that the Petitioner shall furnish the attested copies of Annexure-3 series along with certified copy of this order to the Executive Officer, Bhadrak Municipality (Opposite Party No.2) within a period of two weeks hence. 6.1. On receipt of the same, the Executive Officer, Bhadrak Municipality shall act in accordance with the directions made above. 7.
Since the writ petition is disposed of at the stage of admission without issuing notice to the Opposite Party Nos.2 and 3, they are at liberty to seek for variance of this order, if they feel aggrieved. 8. Urgent certified copy of this order be granted on proper application. (K.R. Mohapatra)
