Learned Additional Government Advocate takes notice for both the respondents.

Learned counsel for the petitioner submits that the petitioner grandfather's brother, late Sri.Chinnappa Swamy S/o. Pillaiah, purchased the lands in question namely 2 acres in Survey No. 39/12 of Gollahalli Village, Uttarahalli Hobli, Bangalore South Taluk, under registered sale deed dated 21.08.1969 from Sri.Muniyappa. It is submitted that the said Muniyappa was granted the lands in question in the year 1955. Now the petitioner has given a representation on 02.03.2026 to respondent No.2-Tahsildar, Bangalore South Taluk, to enter the name of the petitioner in the revenue records.

Learned Additional Government Advocate raises an objection that the petitioner has not produced any material along with the writ petition to show that the RTCs are standing either in the name of Muniyappa or in the name of Chinnappa Swamy. That being the position, it would be impermissible for the Tahsildar to entertain the application filed by the petitioner. Learned Additional Government Advocate submits that the petitioner may be directed to approach a competent Civil Court to get a declaration of title.
4. There is substance in the submission made by the learned Additional Government Advocate. Since the petitioner has not placed any material before this Court to show that the RTC is either standing in the name of Sri.Muniyappa or in the name of Chinnappa Swamy, such directions cannot be issued to the Tahsildar.
5. Accordingly, the writ petition stands disposed of reserving liberty to the petitioner to approach the competent Civil Court, to get a declaration of title.
Ordered accordingly.
